1.1 This information notice establishes the manner in which files in the Federal Circuit and Family Court of Australia (the Court) may be constituted.
1.2 This information notice replaces Information Notice – Court File (published 7 March 2017).
1.3 The official file containing the court record for any proceedings in the Court, subject to any order made by the Court in that proceeding, is:
- for all proceedings for which a digital court file has been created by the Court – the digital file for that proceeding; and
- otherwise – the paper file created by the Court for that proceeding.
1.4 The Court manages its official records, including the official case file containing the court record for each proceedings, under the Archives Act 1983 (Cth) in accordance with specific and general authorities and normal administrative practice approved by the National Archives of Australia.
