Please Note: System updates have been completed and urgent applications can now be eFiled through the Commonwealth Courts Portal with the reduced number of documents set out in the relevant Family Law Practice Direction.
With the commencement of the Family Law Amendment Act 2023 and the Family Law (Information Sharing) Act 2023 on 6 May 2024, amendments were made to the Family Law Practice Direction: Parenting Proceedings and Family Law Practice Direction: Financial Proceedings, reducing the documents that need to be filed for an urgent application to be considered.
Currently, an urgent Initiating Application cannot be eFiled through the Commonwealth Courts Portal without all of the documents set out in paragraph 2.5 of the Family Law Practice Direction: Parenting Proceedings and paragraph 2.6 of the Family Law Practice Direction: Financial Proceedings being filed.
Work is underway to update the system with the change anticipated to be in place by the end of June 2024. In the meantime, if you seek to file an urgent Initiating Application with the reduced documents outlined in the practice directions, you can lodge them for filing by email to the Court registry where the matter is being heard.
