The Affidavit for eFiling (Divorce) forms part of the Application for Divorce and must be signed by the applicant or applicants for a divorce to proceed.
If you are filing a sole application, you are the only party required to sign the Affidavit for eFiling (Divorce). If you are filing a joint application, both parties must sign the Affidavit for eFiling (Divorce). The signature/s must be witnessed by a Justice of the Peace or a Lawyer.
TIP: For a joint application, both parties can either sign at the same time or at different times. Each signature must be witnessed and dated separately but can be witnessed by the same authorised witness on the same date. Both parties can sign separate forms but both must be filed at the same time.
Note: If the Affidavit for eFiling (Divorce) is not witnessed correctly it may be rejected and you will be required to have the page re-signed and witnessed.
The Affidavit for eFiling (Divorce) must be eFiled as part of the online Application for Divorce or can be eFiled after the application has been filed e.g. if you are required to re-sign. See How do I eFile? for a step-by-step guide to eFiling.
