This notice is used by a person who wishes to dispute an Itemised Costs Account when the amount of legal costs and expenses is in dispute.
This notice must be served on the person entitled to costs within 28 days of the service of the Itemised Costs Account.
If parties are unable to resolve the dispute after this notice has been served, either party may ask the Court for an assessment of costs by filing a copy of this notice and the Itemised Costs Account no later than 42 days after service of this notice. The party/lawyer lodging the documents must complete Part D of this notice. The notices can be emailed or posted to the court registry where the matter is being heard.
